1. Acceptance and Service Overview

 

1.1. Acceptance: By clicking "I agree" or by using the Service, you represent that you are at least 16 years old (or the minimum age required in your jurisdiction to enter into a contract) and that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy and Community Guidelines.

1.2. Service Description: Njangi is a community-led platform designed to facilitate live, mutual exchange of African language skills and culinary arts through text, voice, and video communication.

 

2. User Accounts and Eligibility

 

2.1. Account Creation: You must register for an account using your true and accurate information. You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

2.2. Eligibility: You must be at least 16 years old. You may not use the Service if we have previously disabled your account for a violation of these Terms or if you are a convicted sex offender.

 

2.3. Single Account: You may maintain only one Njangi account at any given time.

 

3. User Content and Community Rules

 

3.1. User Content Defined: "User Content" includes all information, recipes, language notes, text, photos, audio, video, and other material that you upload, post, transmit, or share on the Service (including content created during live sessions in Houses or direct chats).

 

3.2. Ownership of Your Content: You retain all ownership rights in your User Content.

 

3.3. Njangi's License to User Content: By submitting User Content to the Service, you grant Njangi a worldwide, non-exclusive, royalty-free, perpetual, transferable, and sublicensable right and license to use, host, store, reproduce, modify, display, and distribute your User Content (including House details and recipes) solely for the purpose of operating, improving, promoting, and developing the Service. This includes using your voluntarily submitted videos in promotional materials, subject to compensation as agreed.

 

3.4. Community Guidelines: You agree to abide by our Community Guidelines (incorporated by reference herein). Prohibited conduct includes, but is not limited to:

• Sharing or transmitting illegal, harmful, threatening, or harassing content.

• Spamming, commercial advertising outside of designated areas, or soliciting other users for external business.

• Infringing upon the intellectual property or privacy rights of others.

• Recording or distributing sessions or private communication without the explicit consent of all participants.

 

3.5. Content Moderation and Removal: Njangi reserves the right, but is not obligated, to review, screen, remove, or disable access to any User Content that we, in our sole discretion, deem a violation of these Terms or the Community Guidelines.

 

4. Financial Terms (Credits)

 

4.1. In-App Currency (Credits): Credits are the in-app virtual currency used exclusively for transactions related to cooking sessions (Houses). Credits are purchased with real currency.

 

4.2. Credits are a Limited License: When you purchase Credits, you receive a limited, non-transferable, revocable license to use them solely within the Service. Credits are NOT real currency and have no cash value.

 

4.3. No Refunds: All purchases of Credits are final and non-refundable, unless otherwise required by law or the policies of the mobile app store (e.g., Apple App Store or Google Play Store). Credits cannot be redeemed for cash or transferred outside the Service.

 

4.4. Termination of Credits: If your account is terminated due to a violation of these Terms, any remaining Credits in your account will be forfeited without compensation.

 

5. Intellectual Property

 

5.1. Njangi IP: All intellectual property rights in the Service (excluding User Content), including the software, code, design, logos, and trademarks ("Njangi IP"), are owned by Njangi or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

 

5.2. Restrictions: You agree not to copy, modify, distribute, sell, or lease any part of the Njangi IP, nor may you reverse engineer or attempt to extract the source code of the app.

 

6. Disclaimers and Limitation of Liability

 

6.1. No Professional Advice: Njangi is a platform for community exchange. We are not a professional cooking school or certified language institution. Users are responsible for exercising caution when following recipes (especially regarding allergies or food safety) and when practicing languages.

 

6.2. Disclaimer of Warranties (AS IS): The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Njangi disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

 

6.3. Limitation of Liability: To the maximum extent permitted by law, Njangi shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising out of or related to your use of the Service, your interactions with other users, or any technical failures, even if we have been advised of the possibility of such damages.

 

7. Termination

 

7.1. Termination by You: You may stop using the Service and terminate your account at any time via the app settings.

 

7.2. Termination by Njangi: We may suspend or terminate your account and access to the Service at any time, for any reason, including, but not limited to, breach of these Terms (especially Section 3 and 4) or the Community Guidelines, without prior notice or liability.

 

8. Governing Law and Dispute Resolution

 

8.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Insert Governing Jurisdiction, e.g., the State of California, USA, or the Republic of Ireland for international reach], without regard to its conflict of law principles.

 

8.2. Informal Resolution: For any dispute arising out of or relating to these Terms, you and Njangi agree to first attempt to resolve the matter informally for a period of at least sixty (60) days.
